ATHEON Terms of Service

Terms governing your use of ATHEON.

1. Acceptance of terms

By downloading, installing, or using ATHEON Workout Tracker ("ATHEON", "the app") from Google Play, the Apple App Store, or another authorized source, you agree to these Terms of Service. If you do not agree, do not use the app. Your use of the app is also subject to any applicable Google Play or Apple App Store terms.

2. Description of the service

ATHEON is a local-first, offline workout tracking application. It allows you to:

  • Create workout programs.
  • Log workouts (sets, reps, weights, timestamps, and notes).
  • Track your workout and progress history over time.
  • Record GPS runs, including routes, pace, distance, and duration.
  • Use workout, rest, exercise, and run timers.
  • Explicitly export and import supported program and workout history files.

All data you create is stored locally on your device in a SQLite database or app storage. ATHEON has no backend server, no cloud storage, no synchronization, and no user accounts or login. The app uses local (on-device) notifications and haptic feedback only. No data is transmitted to MCVC. Data leaves your device only when you explicitly export it and choose where to save or share the file.

3. Your responsibility for your data

  • Your data exists only on your device and in any files you explicitly export. You are responsible for it.
  • Back up your device or export supported data if you wish to preserve it. Because there is no cloud copy held by MCVC, uninstalling the app, clearing its data, losing your device, or device failure may permanently and irrecoverably lose your ATHEON data.
  • We cannot recover, restore, or access your data under any circumstances, as we never hold a copy of it.
  • You are responsible for protecting and appropriately handling files you choose to export or share.

4. Your responsibility for exercise and safety

ATHEON is a tracking tool only. You are solely responsible for your training decisions and for any exercise you perform. Use of the app is subject to the Fitness & Health Disclaimer, which forms part of these Terms and is incorporated by reference.

5. Acceptable use

You agree not to:

  • Use ATHEON for any unlawful purpose.
  • Reverse-engineer, decompile, or attempt to extract source code, except where permitted by applicable law.
  • Tamper with, disrupt, or attempt to circumvent the app's intended functionality.
  • Use the app in any way that infringes the rights of others or violates applicable law.

6. Ownership of content

  • Your data: you own the workout programs, logs, history, profile information, and GPS run data you create. They are stored locally on your device and remain entirely yours.
  • The app: ATHEON itself, including its software, design, and any system-provided templates, is owned by MCVC and licensed to you for personal, non-commercial use within the app. These Terms grant you no ownership of the app itself.

7. "As-is" — no warranty

ATHEON is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that it will meet your specific requirements. We do not guarantee against data loss, as all data is stored locally under your control.

8. Limitation of liability

To the maximum extent permitted by applicable law, MCVC shall not be liable for:

  • Any injury, harm, or loss arising from your exercise activities or your use of the app (see the Fitness & Health Disclaimer).
  • Any loss, corruption, or unrecoverability of your locally stored or exported data.
  • Any indirect, incidental, or consequential damages arising from use of the app.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including certain mandatory consumer rights in the EU/EEA, the UK, and the US.

9. Governing law

These Terms are governed by the laws of Bosnia and Herzegovina. ATHEON is available to users in multiple regions (including the EU/EEA, UK, and US); mandatory consumer-protection rights in your country of residence continue to apply to you regardless of this clause.

10. Changes to these Terms

We may update these Terms as the app evolves. Material changes will be reflected in-app and by updating the "Effective Date" above. Continued use after changes take effect means you accept the updated Terms.
